We are Studio Stach, doing business as BackupMyCalendar (“Company”, “we”, “us”, or “our”).

We operate the website https://www.backupmycalendar.com (the “Site”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

These Legal Terms constitute a legally binding agreement between you and us. By using our Services, you agree to these terms. If you do not agree, you must discontinue use.

1. Our Services

BackupMyCalendar integrates with your existing calendar to provide fully automated backups. The Services may not be used in countries or jurisdictions where such use is illegal. You are responsible for complying with applicable local laws.

2. Intellectual Property Rights

All content, software, and trademarks provided through our Services are the property of Studio Stach or our licensors. You may access and use the Services for personal or internal business use only.

3. User Representations

By using the Services, you represent that you are at least 18 years old, that all provided information is accurate, and that you will use the Services in accordance with these terms and applicable law.

4. User Registration

You may need to register for an account. You are responsible for keeping your password secure.

5. Purchases and Payment

Payments are processed via Stripe. We may adjust pricing and correct errors at any time. If a payment fails (e.g., due to insufficient funds or SEPA rejection), a €50 administration fee is charged.

6. Subscriptions

Subscriptions auto-renew unless cancelled. Your payment method is charged without further approval each cycle (monthly or yearly). Cancel via your dashboard (https://www.backupmycalendar.com/membership-account/) at least 1 day before renewal, or via email (support@backupmycalendar.com) at least 30 days prior. We do not offer refunds for unused periods.

7. Prohibited Activities

As a user, you agree not to misuse the Services, including but not limited to:

  • Using the platform to launch attacks (e.g., DDoS);
  • Violating intellectual property or applicable laws;
  • Circumventing access controls or impersonating others;
  • Attempting to interfere with the infrastructure or overloading the system with excessive requests.

Violations of this policy may result in immediate termination without refund.

8. Disclaimer

The Services are provided “as is.” We make no warranties of any kind, either express or implied. You use the Services at your own risk. The Services are provided as a best-effort system. We target 99.9% uptime but provide no guarantees. Planned or emergency downtime may occur without prior notice. Backups are provided on a best-effort basis. Scheduled intervals (e.g., hourly) are not a hard guarantee, and no refunds are given for missed backups.

9. Limitations of Liability

We are not liable for any indirect or consequential damages. Our total liability is limited to the amount paid by you in the last 6 months.

10. Services Management

We may monitor use and enforce these terms. We may limit access or remove content that causes excessive load or violates policy. Calendar file size is limited to 10 MB (10,485,760 bytes). Excessive usage may be throttled to protect service quality for others. Given that our backup service depends on third parties to provide the calendars to be backed up, you are solely responsible for making sure these third parties deliver the calendars in a correct manner. We may delete old backups to save storage space.

11. Contribution Licence

By submitting ideas, feedback, or content, you grant us a non-exclusive, transferable, worldwide license to use, copy, modify, and publish them for any lawful purpose.

12. Term and Termination

We may terminate or suspend your account at our sole discretion, without notice, for violations of these terms or any misuse of the platform. We may correct errors or omissions in our content, prices, or terms at any time. To keep the load on the servers minimal, non-paying users are required to log in to their accounts at least once every 6 months. Inactive accounts may be suspended without notice.

13. Governing Law

These terms are governed by Dutch law. Legal disputes shall be resolved via the competent court: Rechtbank te Almelo.

14. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Services or violation of these terms.

15. Electronic Communications

You consent to receive communications electronically. All agreements, notices, and disclosures are valid in electronic form.

16. Miscellaneous

These Terms constitute the full agreement. If any clause is found unenforceable, the rest shall remain in effect. We may assign our rights at any time.

FAQ

Yes, you can get started absolutely free of charge with one calendar and one backup per week. If you want more calendars and hourly backups, take a look at our plans.

For the free plan, we make one backup per week. For the paid plans, starting from €3 per month, we make one backup per calendar per hour.

We have an advanced backup retention schedule. We keep at least 1 backup for every hour in the last 24 hours, at least 1 backup for every day in the last 7 days, at least 1 backup for every week in the last 4 weeks, at least 1 backup for each month in the last year, and at least 1 backup per year.

Yes. We keep your data in secure, GDPR-compliant data centres in the European Union. We don’t need your Google, Apple, or Microsoft passwords, and we cannot make changes to your calendars. Only you can download your backups.
